CFTC is probing Iran oil trades and candidates who bet on their own races, enforcement chief says

The CFTC’s enforcement director, David Miller, said on 22 October that the agency is investigating suspicious oil trading around the Iran conflict, is watching election trading on prediction markets, and wants large offshore platforms that serve Americans to register. What he said and what it means for Kalshi and Polymarket users.

The CFTC is investigating suspicious trading around the Iran conflict and has looked at candidates trading on their own elections, the agency's enforcement director said on 22 October 2026. Speaking at the NEXTPredict prediction market conference in New York, David Miller also said the CFTC wants large offshore prediction markets that serve US users to register with it.

The three things Miller said

1. Oil trading around Iran. The agency is running what Miller called a "robust investigation" into oil futures trades placed before US announcements on Iran, and has been looking into it "from the beginning". He said a Bloomberg report on the case contains "factual inaccuracies", without saying which. That report said a political appointee had asked career staff to withdraw an enforcement referral.

2. Elections. The CFTC is watching for problematic trading on election outcomes, Miller said, though he would not discuss the November midterms specifically. Staff "have investigated, and may have open investigations about some candidates who have placed trades on contracts that are based on their own elections."

3. Offshore platforms. The agency wants large offshore prediction markets that touch American users to register. Whether a platform outside the US falls under CFTC jurisdiction depends on the "facts and circumstances", he said, citing the collapse of FTX as the reason registration matters.

Why it matters for prediction markets

  • Candidates betting on themselves. Kalshi has already fined and suspended several congressional candidates who traded on their own races this year. Miller's comments suggest the regulator could go further than platform bans (insider trading cases).
  • Offshore exchanges. Polymarket runs two venues: a CFTC-regulated exchange for US users and a global one offshore. The call for registration is aimed at platforms like the global one (is Polymarket legal in the US?).
  • A busier regulator. The same week the CFTC stopped two sports contracts at Novig and ProphetX (micro contracts), weeks after proposing to define event contracts as swaps (the CFTC proposal).

What it means for traders

Trading on confidential information, or on an outcome you control, is illegal on a regulated exchange and banned by the platforms' rules. With midterm volume at records (midterm trading volume), surveillance of election markets is likely to tighten. If a price moves sharply before any news, treat it as a warning sign rather than an opportunity.
